Terms of Service
Agreement between you and BORDGENOTEN
Last updated: December 26, 2024. These Terms of Service ("Terms") govern your use of BORDGENOTEN. By creating an account, you agree to these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using BORDGENOTEN, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.
We may modify these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.
2. User Accounts
To use BORDGENOTEN, you must:
- Be at least 18 years old
- Provide accurate, current information
- Maintain the security of your account
- Accept responsibility for all activity under your account
- Not impersonate others or create multiple accounts
- Maintain an active membership to book or host dinners
3. Membership & Payments
- Membership is required to access platform features
- Three tiers available: Community (€24/year), Supporter (€36/year), Standard (€49/year)
- Memberships are non-refundable except during 14-day guarantee period
- Dinner payments are separate and paid directly to hosts via Tikkie
- Hosts receive payment before the dinner takes place
- We are not responsible for disputes between hosts and guests regarding dinner quality
4. Host Responsibilities
As a host, you agree to:
- Provide accurate dinner information (date, time, menu, capacity)
- Maintain a clean, safe environment
- Accommodate disclosed dietary restrictions
- Review and approve/decline booking requests within 24 hours
- Not discriminate based on protected characteristics
- Comply with local laws and regulations
- Report any issues or incidents to BORDGENOTEN
5. Guest Responsibilities
As a guest, you agree to:
- Provide accurate information in booking requests
- Disclose dietary restrictions and allergies
- Pay promptly after booking approval (within 2 hours)
- Attend confirmed dinners or cancel within 24-hour window
- Respect host's home, rules, and property
- Behave appropriately and respectfully
- Not bring uninvited guests without permission
6. Cancellation Policy
- Guests can cancel up to 24 hours before dinner for full refund
- Cancellations within 24 hours are non-refundable
- Hosts can cancel at any time with full refund to guests
- Repeated cancellations may result in account restrictions
- No-shows are tracked and may lead to suspension
- Force majeure events are considered case-by-case
7. Prohibited Conduct
You may not:
- Use the platform for commercial purposes without authorization
- Post false, misleading, or fraudulent content
- Harass, threaten, or discriminate against others
- Share inappropriate content or messages
- Attempt to bypass payment or verification systems
- Scrape, copy, or reproduce platform content
- Violate any local, state, or national laws
8. Intellectual Property
BORDGENOTEN owns all rights to the platform, including code, design, logos, and content.
You retain ownership of content you post but grant us a license to use it for platform operation.
You may not use our trademarks without written permission.
9. Liability & Disclaimers
- Platform provided "as is" without warranties
- We are not responsible for actions of hosts or guests
- We do not guarantee safety, quality, or legality of dinners
- Total liability limited to membership fees paid
- You participate at your own risk
10. Dispute Resolution
Most disputes can be resolved through our support team.
If not resolved, disputes are subject to binding arbitration under Dutch law.
Legal actions must be brought in Amsterdam, Netherlands.
11. Termination
- You may delete your account at any time
- We may suspend or terminate accounts for violations
- Serious violations result in immediate termination
- Upon termination, you lose access to all platform features
- Refunds are not provided for membership terminations
12. Changes to Service
We may modify, suspend, or discontinue any part of the service at any time.
We are not liable for any modification or discontinuation.
